Aguinaco Abogados was founded in 1972 by Vicente Aguinaco Alemán and Fabián Aguinaco Bravo.

Aguinaco Abogados is one of the leading constitutional law firms in Mexico, with practice in constitutional procedural law and Amparo Trial.

José Vicente Aguinaco Alemán

Born on July 14, 1919 in Salamanca, Guanajuato.

He earned his law degree from the Universidad Nacional Autónoma de México.
He served as a district judge in Yucatán, Aguascalientes, Puebla and Mexico City.
He served as a Circuit Court judge in the Second Circuit in Toluca, in the Seventh Circuit in the Port of Veracruz and in the Third Circuit in Guadalajara, Jalisco.
After a successful career in the Federal Judiciary, in 1972 he founded Aguinaco Abogados, together with Fabián Aguinaco Bravo, which he headed until 1995.
He participated in the drafting and discussion of the amendments to the Mexican Constitution regarding the Federal Judiciary, published in the Official Journal of the Federation on December 31, 1994.
On February 1, 1995, he was sworn in as a Justice of the Supreme Court, which he chaired, as well as the Federal Judiciary Council, from that date until 1998.
On August 15, 1998, the Bar Association of the State of Guanajuato awarded him and declared him "Distinguished Guanajuatense".
On December 3rd of the same year, the Mexican Bar Association awarded him the "National Jurisprudence Award 1998".
He retired from the Supreme Court on December 1st, 2003, and rejoined Aguinaco Abogados. He passed away on September 30, 2007, in Mexico City.

NATIONALIZATION OF THE BANKING SYSTEM

In September 1982, the President of the Republic decreed the nationalization of the banking system and the generalized control of foreign exchange through a constitutional ammendment. The representatives of the country´s main banks entrusted the firm with the joint defense of the industry.

INDEPENDENT CANDIDACIES

Litigation brought before the Inter-American Court on Human Rights for the lack of an adequate and effective legal resource for the registration of independent candidacies in México. (Castañeda Gutman vs. United Mexican States, 2008).

SHARED MICROMOBILITY

Advocacy of shared micromobility companies to shape public policies towards sustainable, accessible, multimodal and non-motorized mobility.

ECOLOGICAL TAXES OF THE STATE OF ZACATECAS

Successful defense, before the Mexican Supreme Court, of an important Mexican mining company against four environmental taxes of the State of Zacatecas (Ecological Taxes, 2020).

AICM AIRPORT SLOTS AS AN ESSENTIAL INPUT

Successful defense in amparo of one of the most important aviation companies in the United States of America against the Mexican Federal Economic Competition Commission. The resolution in which it was ruled that the Slots of the Mexico City´s International Airport are an essential input was revoked (AICM Slots case, 2019).

DRUG POLICY REFORM

Led the five cases before the Mexican Supreme Court that declared the unconstitutionality of the General Law of Health that prohibited the personal use of cannabis (SMART case and following, 2015-2019).

CHILDREN WITH DISABILITIES AND INCLUSIVE EDUCATION

Case before the Mexican Supreme Court that acknowledges the right to an integrated and inclusive education, with reasonable accommodations and accessible campuses for indigenous boys and girls with disabilities. Litigation in conjunction with “Mexicanos Primero” (Citlali García García case, 2019).

PEOPLE WITH DISABILITIES AND LEGAL GUARDIANSHIP

First case in which the Mexican Supreme Court declared the unconstitutionality of Interdiction and legal guardianship model. The Court upheld the right to legal capacity and to an independent life. (Tomás Barrón Sánchez case, 2019).
